Basin Closures
If a person wants to appropriate water in a controlled ground water area located within a basin closure area and an Application for Beneficial Water Use Permit is required, the applicant is subject to the requirement of §§ 85-2-360, 85-2-361, and 85-2-362, MCA. Click on the HB831 link below.

Stream Depletion Zones
The department has authority to designate a stream depletion zone within a closed basin to limit the amount of water used under the exceptions to permit requirements under § 85-2-306, MCA, due to the availability of water for the protection of existing water rights. (§ 85-2-102(23) and § 85-2-380, MCA)
A petition may be filed by a municipality; county; conservation district; local water quality district formed under Title 7, chapter 13, part 45; or the owners of at least 15% of the flow rate of the surface water rights in the area estimated to be affected. The petition must be filed with the department pursuant to § 85-2-380, MCA, and there must exist a hydrogeologic assessment for the area where the stream depletion zone is proposed.

Information
Applies only to wells designed and installed for the extraction of coalbed methane (CBM).
CBM development must follow the standards for drilling, completing, testing, and production of CBM wells as adopted by the Board of Oil and Gas Conservation.
CBM operators must offer water mitigation agreements to owners of water wells or natural springs within one-half mile of a CBM operation or within the area that the operator reasonably believes may be impacted by the CBM operation, whichever is greater. This area will automatically be extended one-half mile beyond any well adversely affected.
DNRC will designate a Technical Advisory Committee to oversee groundwater characteristics and monitoring and reporting requirements.
