The Department of Natural Resources and Conservation (DNRC) has issued the following preliminary determinations to grant eight water right applications related to the Black Butte Copper Project located approximately 15 miles north of White Sulphur Springs in Meagher County.
The Department provided public notice containing the facts pertinent to each of these applications, a summary of the Department’s preliminary determinations and associated conditions, pursuant to § 85-2-307, MCA. The Department set a deadline for objections to these applications pursuant to §§ 85-2-307, and -308, MCA. If an application receives no valid objections or all valid objections are unconditionally withdrawn, the Department will grant the application as proposed in the preliminary determination pursuant to § 85-2-310, MCA. If any application receives one or more valid objections, the application and objection(s) will proceed to a contested case hearing pursuant to Title 2 Chapter 4 Part 6, MCA, and § 85-2-309, MCA. If all valid objections to an application are received and withdrawn with conditions stipulated with the applicant, the Department will grant the application subject to conditions as necessary to satisfy applicable criteria pursuant to § 85-2-310, MCA.
